Trade marks: Federal Court confirms “Q1” registration

19 July 2012: The Federal Court of Australia has overturned a decision of the Registrar of Trade Marks refusing to register Mantra IP’s word mark ‘Q1’.  ‘Q1’ also formed the name of an iconic high rise apartment building on the Gold Coast in Queensland.  The Registrar found that the word mark, being used to identify the location of services rather than as a badge of origin, would likely deceive or cause confusion.  The Court found that the word mark had been sufficiently used as a trade mark to distinguish Mantra IP’s services.
